Common Area Title Issues
Many community associations have common area parcels that are still titled in the name of the developer or declarant (or some other entity), post-transition. Such parcels are generally burdened with delinquent taxes. Our firm routinely assists associations in negotiating with developers/declarants to have such parcels conveyed to the association. If the developer/declarant is no longer a viable business entity, our firm is experienced in filing quiet title actions on behalf of associations to clear and obtain title to such parcels.
